HME News is the developer of the HME Databank (DataBank), a database of Medicare reimbursement data. By subscribing to the DataBank, users agree to the following terms and conditions.
For the term of the subscription, HME News grants a non-exclusive, non-transferable right and license to use the data for the purpose of analyzing Medicare reimbursement in the home medical equipment market. Each subscriber may have unlimited use of the data in the DataBank for use within their organization.
Without limiting the generality of the foregoing, subscribers are expressly prohibited from sublicensing, transferring or reselling data obtained from the DataBank. No rights or licenses to trademarks, invention, copyrights or patents are implied or granted.
Content on the Databank is provided "as is" without warranties of any kind either expressed or implied. To the fullest extent possible pursuant to the applicable law, HME News disclaims all warranties, expressed or implied, including, but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement or their violation of rights. HME News does not warrant or make any representations regarding the use, validity, accuracy, or reliability of, or the results of the use of, or otherwise respecting, the content or operation of the DataBank.
Under no circumstances, including, but not limited to, negligence, shall HME News be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on the DataBank, even if an HME News authorized representative has been advised of the possibility of such damages. If your use of materials from the DataBank results in the need for servicing, repair or correction of equipment or data, you assume any costs thereof. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusion may not apply to you.
