HME News is the developer of the HME Databank (DataBank), a database of Medicare reimbursement data. By subscribing to the DataBank, users agree to the following terms and conditions.
For the term of the subscription, HME News grants a non-exclusive, non-transferable right and license to use the data for the purpose of analyzing Medicare reimbursement in the home medical equipment market. Each subscriber may have unlimited use of the data in the DataBank for use within their organization.
Without limiting the generality of the foregoing, subscribers are expressly prohibited from sublicensing, transferring or reselling data obtained from the DataBank. No rights or licenses to trademarks, invention, copyrights or patents are implied or granted.
Content on the Databank is provided "as is" and “as available,” without warranties of any kind either expressed or implied, including but not limited to any warranty that operation of or access to the Databank will be uninterrupted, error free or free from viruses or other harmful components. To the fullest extent possible pursuant to applicable law, HME News disclaims all warranties, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement or other violation of rights. HME News does not warrant or make any representations regarding the use, validity, accuracy, completeness or reliability of, or the results of the use of, or otherwise respecting, the content or operation of the DataBank.
To the maximum extent permitted by applicable law, under no circumstances, including but not limited to claims arising under contract, negligence or any other theory of liability, shall HME News be liable for any direct, indirect, special, punitive, incidental or consequential damages, including but not limited to loss of data or loss of anticipated profits, arising out of the use, or the inability to use, the DataBank information or materials, even if an HME News authorized representative has been advised of the possibility of such damages. If your use of information or materials from the DataBank results in the need for servicing, repair or correction of equipment or data, you assume any costs thereof. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusion may not apply to you. If you are dissatisfied with any part of the Databank, related information or services, or these terms, your sole and exclusive remedy is to discontinue your use.
